Terms of Service
These Terms are a binding agreement between you and Sunny Simms Inc., which operates Yardsale Club (“we”, “us”). By using the app you agree to them. If you don’t agree, don’t use the app.
What Yardsale Club is
We aggregate and host listings for yard, garage, and estate sales, and let neighbors list items, make offers, coordinate pickups, message each other, and rate the people they buy from and sell to. Sales happen in person, directly between you and the other party. We are a venue, not a party to any transaction. We are not a buyer, seller, broker, agent, escrow, or payment processor for items. We don’t take possession of items, don’t process payment for them, and don’t guarantee the condition, quality, legality, safety, or availability of anything listed, or that any buyer or seller will actually show up or follow through. Any dispute over a sale is between the people involved.
Eligibility & your account
You must be at least 13 to use the app, and at least 18 to list a sale or item, request or accept a pickup, or buy a subscription or boost. You’re responsible for everything that happens on your account and for keeping your login secure. Provide accurate information and keep it current. You can delete your account at any time in Settings.
Listings, offers & pickups
When you list an item you confirm it’s yours to sell, the photos are real, and the details are accurate. An offer is a non-binding request to buy at a stated price; nothing is final until both people agree in person. The pickup coordination tools (request a pickup, accept, propose times, release the address, share a rough ETA, confirm the handoff) are conveniences to help you arrange a meeting — they don’t obligate anyone to complete a sale, and we are not involved in the meeting or the exchange. Either side can cancel at any point. The availability badge on a listing reflects the app’s record of pickup status; it is not a guarantee.
Payments
Items are paid for in person, directly between buyer and seller. The in-app payment-method field (cash, Venmo, etc.) is a convenience for the two of you to agree on a method — we do not collect, hold, transmit, or guarantee any payment for an item, and we offer no refunds, returns, or buyer/seller protection for sales. Service-provider subscriptions and listing boosts are billed through Stripe; subscriptions renew monthly until cancelled (cancel any time from the billing portal and keep access through the paid period), and boosts are one-time and non-refundable once the boost period starts.
Meeting in person & assumption of risk
Yardsale Club connects you with strangers and, when you arrange a pickup, a seller may share a private home address. There are real risks to meeting people and going to or hosting at a residence. You assume all risk of your in-person interactions. We do not screen, verify, or run background checks on users, and we don’t verify any address or location. Use common sense: meet in daylight or a public place when you can, bring a friend for high-value or large items, don’t share more than you need to, and trust your gut. As a host, you decide if and when to release your address and you are responsible for your own premises and safety. You release Sunny Simms Inc. from claims arising out of disputes with, or the acts or omissions of, other users or third parties.
Ratings & reviews
After a completed pickup, buyers and sellers can rate each other, and those ratings build a public reputation score. Ratings and reviews are the personal opinions of the people who leave them — we don’t endorse, verify, or guarantee them. Rate honestly and based on your own experience. Don’t post fake, retaliatory, or abusive ratings, and don’t trade or coerce ratings. We may remove ratings or reviews that break these rules, and we’re not liable for what users say about each other.
Community rules — zero tolerance
There is zero tolerance for objectionable content or abusive behavior. Don’t post content that is illegal, dangerous, hateful, harassing, sexually explicit, fraudulent, or spam. Don’t list prohibited items — including weapons, drugs or other regulated/controlled goods, stolen goods, recalled or unsafe products, counterfeits, or anything you can’t legally sell. Don’t harass other users in messages, offers, or ratings.
Every piece of user content can be reported in the app, and any user can be blocked. We review reports promptly (we aim for within 24 hours), remove content that breaks these rules, and remove repeat or egregious offenders.
Prohibited conduct
Don’t use the app to break the law or these Terms; don’t impersonate others or misrepresent items; don’t scrape, harvest, or copy the app’s data with bots or automated tools; don’t attempt to bypass safety, security, or rate limits; and don’t interfere with the app’s operation or other users’ use of it.
Your content
You own what you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it in the app and in service communications (for example, sale alerts) for as long as you keep it posted. You promise you have the right to post it.
Disclaimers
The app is provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. Listing details — including sales we aggregate from other sites — can be wrong, incomplete, or out of date. We don’t warrant that the app will be uninterrupted, error-free, or secure, or that any listing, user, sale, or pickup will meet your expectations.
Limitation of liability
To the fullest extent the law allows, Sunny Simms Inc. is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or data, or for anything that happens at or results from an in-person sale or pickup. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Sunny Simms Inc. and its owners, officers, and staff from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the app, your content, your interactions or transactions with other users, or your violation of these Terms or of any law or third-party right.
Suspension & termination
We may suspend or terminate your access at any time if you breach these Terms or our community rules, or to protect the app or its users. You may stop using the app and delete your account at any time. Sections that by their nature should survive — including content license, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
Dispute resolution & governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing any claim, contact us first at [email protected] so we can try to resolve it informally; most issues can be settled this way within 30 days. If we can’t, you and Sunny Simms Inc. agree to resolve disputes by binding individual arbitration on a non-class basis, and you waive the right to a jury trial and to participate in a class action, except that either party may bring qualifying claims in small claims court. The exclusive venue for any matter not subject to arbitration is the state and federal courts located in Riverside County, California. Any claim must be brought within one year after it arises.
Changes
We may update these Terms; material changes will be announced in the app and reflected in the effective date above. Continuing to use Yardsale Club after a change means you accept it.
